A Louisiana man recently required immediate medical attention following an accident involving a dump truck and a portable toilet. This incident occurred at the Louis Armstrong International Airport where there is currently construction of a new terminal underway. The injuries suffered by the victim are said to be quite severe, which is on par for truck accidents.
On Thursday, Sept. 21, a 28-year-old male was using a portable toilet located on the construction site when it was crushed by a dump truck. The driver of the truck claims to not have seen the Port-O-Potty and backed up over it. The victim suffered numerous fractures, internal bleeding and a collapsed lung as a result of the incident. He was taken to a hospital in serious condition.
Police were called to the scene and are said to be investigating the matter. The driver of the truck was not arrested. It is unknown if any citations are pending.
The victim, who was on the clock at the time of the incident, may be entitled to utilize workers’ compensation benefits for his care and recovery. On top of that, he may be entitled to pursue third-party legal claims against the truck driver and that individual’s employer. Following truck accidents, in order for personal injury claims to be successful, it will be necessary for negligence to be established. In this case, if the victim and his legal team can prove that the truck driver was negligent in his actions, a Louisiana civil court may award him a monetary judgment.
