Motor vehicle accidents may lead to pedestrian deaths

A woman has sadly lost her life in a pedestrian crash in Louisiana. Now, her family members are left to grieve and wonder how such an accident could have claimed their loved one's life. Sometimes, these types of motor vehicle accidents happen as a result of driver negligence, which is grounds for litigation.

The recent Louisiana accident took place on a Wednesday at a little after 1 p.m. According to authorities, a 32-year-old woman was waiting in a median at an intersection to cross a street. All of a sudden, a car reportedly ended up leaving the street and striking the woman.

The pedestrian was pronounced dead at the accident scene. Meanwhile, the car's driver was taken to a hospital with injuries. Authorities said they were not sure as to why the car left the street, but they continued to investigate the pedestrian accident.

Police in Louisiana may discover through their investigation that the driver caused the accident due to distracted driving, for example. In this situation, the surviving family members of the pedestrian who died in the accident may opt to file a wrongful death claim against the driver, seeking the reimbursement of monetary damages. They must establish liability before the civil court hearing the case before a judge will determine their claims for damages. If they are successful, the plaintiffs may receive a monetary award to cover the deceased victim's funeral costs. The damage award might also help with addressing emotional distress as well as cover other losses associated with these types of motor vehicle accidents.
