In early April, a story broke in Louisiana about an on-duty deputy striking a pedestrian, killing the victim. Authorities are still investigating this incident so not many details have been released; however, what information is out there may have the victim’s family questioning if they have the right to seek compensation for their losses. Under certain circumstances, they may be entitled to file a wrongful death claim against the deputy, his department and anyone else potentially liable in this case.
According to reports, the deputy — a 20-year-old male — was driving on LA 1 southbound around 1:30 a.m, on his way to collect a work-release inmate. When he was near Emily Drive, he hit a man allegedly walking in the street. The victim — a 37-year-old male — died from his injuries at the scene of the accident.
At this time, no charges have been filed in this case. It is unclear if any will be. The deputy was cited for driving on a suspended license, however. Why he was allowed to operate a work release van without a valid license is still unknown.
Right now there are a lot more questions in this case than there are answers. Time will bring the truth of this matter to light. If it is believed that driver negligence was responsible or even partially responsible for the victim’s death, his surviving family members may pursue a wrongful death claim, and any other claims applicable under the circumstances, in a Louisiana civil court in order to seek monetary damages for any losses state laws deem recoverable.
