Louisiana wrongful death: Man killed while crossing 3rd Avenue

Police in Lake Charles were called to investigate a pedestrian accident that occurred on the morning of Dec. 13. Sadly, the victim suffered critical injuries and did not survive long after the event. This individual’s family may be entitled to seek compensation for their losses by filing a wrongful death claim against the driver responsible.

According to reports, the victim — a 53-year-old male — was crossing 3rd Avenue at roughly 6:30 a.m. when he was struck by a truck. Police say the man was in the crosswalk when he was hit. Emergency crews rushed the victim to the hospital with critical injuries. Sadly, he died two days later.

Little information is known about the driver. Authorities did ticket this individual for failure to yield and driving with a suspended license. They do not believe impairment contributed to this incident. The investigation is still in process. It is unclear if any criminal charges will be filed in this case.

Pedestrians in Lake Charles can do everything right. They can cross in crosswalks and be cautious and aware of their surroundings, but it may do them no good if drivers are not looking out for them as well. While it is unclear why this driver hit this pedestrian, if negligence contributed to the event the victim’s surviving family members may seek monetary damages for their losses. This they can do by filing a wrongful death claim in a Louisiana civil court. In order for such a legal claim to be successful, it will be necessary for the victim’s family to establish negligence to the court’s satisfaction and provide documentation for any damages sustained.
