Louisiana wrongful death: Motorcyclist struck and killed

The driver responsible for hitting a motorcyclist has been cited for the event. According to Louisiana State Police, this crash occurred the morning of Oct. 17 in Baton Rouge. The victim, sadly, died in the collision. Her surviving family members may be entitled to pursue a wrongful death claim in an effort to seek compensation for their losses.

At around 6 a.m., a 40-year-old woman was operating her motorcycle westbound Siegen Lane. When she was going through the intersection at Perkins Road, an eastbound driver turned left and struck her. The woman was ejected from her vehicle and died at the scene.

The driver — a 27-year-old male — was not injured in the incident. He has been cited with failure to yield. Authorities say additional charges may be filed against this individual. As of the latest report, impairment is not suspected to have been a contributing factor in this case.

Fatal motorcycle accidents seem to happen all too often in Louisiana. When they do and other drivers are believed at fault, it is normal for surviving family members of the victims to question whether they have the right to seek compensation through legal means. At the end of the day, it all comes down to being able to establish negligence. In this particular case, if it is possible to prove that the driver responsible for the collision was negligent in his actions, a civil court may award the victim’s loved ones monetary relief for any economic or noneconomic damages they have experienced as a result of the wrongful death of their loved one.
