Louisiana truck accidents: Train and truck collide

On Behalf of | Oct 29, 2018 | Truck Accidents

A train struck a semitrailer in Louisiana recently, killing one and leaving several others injured. This incident occurred in the afternoon of Oct. 10, in Amite. The truck driver died in the crash. Following truck accidents like this, victims may seek compensation for their losses by filing civil claims against all parties who may be held responsible.

Little information has been reported about this incident. For unknown reasons, the semitrailer was across the tracks at the Louisiana Highway 51 crossing. An Amtrak train carrying 98 passengers struck the truck. As previously stated, the truck driver died and several passengers suffered injuries in the wreck. While initial reports stated all injuries suffered were minor in nature, minor injuries can quickly turn into something serious without proper medical treatment.

Authorities are still in the process of investigating this incident. For victims who may be looking to seek compensation for their losses, what they want to know is who is responsible: the truck driver, the trucking company, the train engineer or Amtrak? They may also want to know what compensation may be available to them. The police investigative report and legal counsel may be able to help answer those questions.

Those injured in truck accidents resulting from negligence may seek relief for all damages deemed recoverable according to Louisiana laws. Such damages include medical expenses, pain and suffering and income loss, among various others. In this particular case, victims may pursue compensation by filing claims against the estate of the truck driver and possibly against the trucking company. If Amtrak is thought to have been at fault for the accident in any way, claims may also be filed against the train engineer and Amtrak. Through settlement negotiations or litigation, maximum relief may be achieved.
