Louisiana wrongful death: Sanitation worker struck and killed

On Behalf of | Sep 29, 2018 | wrongful death

On Tuesday, Sept. 18, a sanitation worker was operating the controls on the side of his garbage truck when he was struck by a passing car. Sadly, this individual died at the scene. In an effort to seek compensation for their losses, the victim’s surviving family members may pursue a wrongful death claim in a Louisiana civil court against the driver deemed responsible for this incident.

This particular accident reportedly occurred on Highway 24 in Terrebonne Parish at 6:30 a.m. The garbage truck was stopped on the shoulder of the left lane when a 26-year-old male driving a pickup truck struck the worker and the garbage truck, pinning the worker between the two vehicles. The victim — a 45-year-old male — died before he could be transported for treatment.

As of the latest report, police are still in the process of investigating the cause of this accident. The drivers of both vehicles were unharmed. It is unclear if any criminal charges will be filed against the young man deemed responsible for this incident.

As the victim was on the job when killed, his family may be entitled to collect workers’ compensation death benefits; however, they may find that such benefits may not cover all of their losses. A successfully navigated wrongful death claim filed in a Louisiana civil court may help them achieve maximum relief. An experienced attorney will be able to review the details of this case and help the victim’s loved ones pursue the correct legal course of action, if doing so is deemed appropriate.
