Woman involved in fatal crash charged with DUI

On Behalf of | Jan 29, 2016 | Car Accidents

There are so many ways that Louisiana drivers can practice safe driving tactics. Staying within speed limits, focusing on the road and awareness are all means of safer driving. Sometimes drivers operate their vehicles in a way that is unsafe to them and all drivers in near proximity. A woman involved in a car accident resulting in the death of a Louisiana toddler has been charged with DUI charge for her role in the crash.

According to reports, the woman struck a family’s vehicle head-on when she drifted into the eastbound lane. The force threw a toddler from the vehicle, ultimately causing his death, and inflicted fatal injuries to the father as well. A toxicology test was taken from the driver who swerved into the family’s lane and she tested positive for benzodiazepines – a class of prescription drugs which includes Xanax and methadone, an opioid used as a pain reliever to reduce withdrawal symptoms associated with addiction to narcotics, including heroin.

The injured family has obviously suffered catastrophic loss and pain and suffering. While there is no way to turn back the hands of time, the DUI charge will help with any pending civil suit. If proven, it will give weight to a claim that the woman was negligent at the time of the crash. Reparations come in monetary form and can be a great help to aid with medical bills, loss of wages, pain and suffering and other means of loss in a situation like this.

Many people ask themselves how a family could find themselves in such a situation? While there is no way to predict how and when these type of terrible car accidents can happen, there are some ways to remedy them. Seeking the assistance of experienced attorneys can help those in such tragic situations form a solid plan of legal action.
