Unfortunately, car accidents can occur in the blink of an eye and alter the lives of victims forever. A multi-car accident in a nearby community east of Lafayette recently left one driver dead. The three-car accident resulted in the death of a 19-year old man. The accident occurred when a pickup truck driven by a 27-year old man was headed north and crossed the median, entering the southbound lanes and striking another pickup truck. A passenger vehicle travelling behind the pickup truck that was hit was unable to avoid the accident and also struck the pickup truck from behind.
The driver of the vehicle that crossed the center median and struck the pickup truck in which the victim died fled that scene and was apprehended by police several hours later. The driver was charged with negligent homicide, hit and run, DWI, as well as a variety of other traffic-related charges. According to police, alcohol impairment may have contributed to the crash. When a drunk driver has negligently caused a victim harm, the victim, or family members of the victim, may be able to bring a personal injury or wrongful death claim for damages.
Victims injured in a car accident may be able to recover damages for medical expenses and other financial and emotion harm. Likewise, surviving family members of victims killed in a car collision may have a claim for damages including medical expenses, funeral expenses and pain and suffering damages, among other types of damages depending on the unique circumstances of the loss. Victims may be able to establish the negligence of the driver that caused the accident through charges or citations the driver received related to the accident.
The loss of a loved one in a drunk driving accident may be the most difficult emotional experience a loved one faces. Because of this, the legal system is designed to protect victims, and family members of victims, in all the ways it can.
