Motorcycle rider killed in collision at Louisiana intersection

On Behalf of | Jun 19, 2014 | Car Accidents

Motorcycle riders are at a heightened risk of serious injury or even death when involved in car accidents. This is largely due to their smaller size and lack of safety features in comparison to other vehicles. It is therefore imperative that both motorcycle riders and drivers of other vehicles sharing the road must exercise the appropriate care when driving near each other.

A recent accident in Louisiana involving a car and a motorcycle has resulted in the death of the motorcyclist. The collision occurred at an intersection of a highway and another road. The car was leaving an exit ramp of the highway when it was struck on the driver’s side by the motorcycle. The motorcyclist died at the scene of the auto accident, while the driver of the car did not sustain serious injury.

Liability for this case is governed by the rule of negligence, as are other motor vehicle accidents in Louisiana. Based on the available facts at this time it is difficult to determine which driver was negligent in causing the accident. However, in two-thirds of such accidents, the driver of a vehicle violates the right of way of the motorcycle rider. One of the reasons for this issue is that motorcycles are relatively smaller than other vehicles on the road, making them difficult to see in adverse weather and traffic conditions, as well as at intersections. Other contributing factors to motorcycle accidents that are not present with other motor vehicles include wobbling at high speeds, a lack of riding experience and road hazards such as potholes, debris and puddles.

Regardless of which party is at fault in causing a motorcycle accident, a motorcycle rider may experience significant injuries as a result. If they are able to show that the car driver liable for their damages they may be entitled to appropriate compensation as a result. However, they may be found to have contributed to their own injuries as well, which can minimize or negate any compensation to which they may otherwise be entitled.
