November is deadliest month in northern Louisiana

The Louisiana authorities report that the holiday season is one of the most dangerous times of the year on the roadways. This year is no exception, as there have already been several fatal accidents.

Louisiana State Patrol Troop F has specifically been keeping track of and publicizing its accident rates. Troop F encompasses northeastern Louisiana: West Carroll, East Carroll, Caldwell, Franklin, Madison, Jackson, Morehouse, Lincoln, Ouachita, Richland, Tensas and Union. The State Patrol reports that there have already been 12 deaths in early November. The number of casualties was expected to rise over the Thanksgiving holiday, when more drivers were on the roads.

One of the major causes of these accidents is impaired drivers. Section 661 of the Louisiana Motor Vehicles and Traffic Regulations governs impaired drivers. It bans drivers from operating a vehicle under the influence of drugs or alcohol.

If an accident results from impaired driving, Louisiana residents injured in the accident can rely on this law to demonstrate that the driver failed to adhere to the appropriate roadway duties. Specifically, the injured party -- or worse, the family who has lost a loved one in a fatal accident -- can argue that the driver was negligent in light of intoxication. In other words, the failure to follow a traffic law can be used by a plaintiff to demonstrate negligence.

While the number of fatal accidents is tragic, there are ways to overcome the loss and pain and suffering. Attempting to recover compensation in a lawsuit by asserting a negligence claim is one way to do so.
