Car and ATV accident results in serious injuries to minors

On Behalf of | Aug 1, 2013 | Car Accidents

When people think about motor vehicle collisions that occur in Louisiana, the first thing that comes to mind is usually an accident involving two cars. But, there are many ways in which car accidents may occur. For instance, accidents can also involve all-terrain vehicles.

Just last week a Louisiana 911 call center received a call about an ATV accident. The accident occurred near Port Barre on East Courtableau road in the early evening. The accident involved a car and an ATV. Witnesses claim that the ATV, which was driven by a 15-year-old and had another 15-year-old passenger riding on it, entered the road right in the way of the other car involved in the collision.

While the driver of the car did not suffer any injuries from the collision, the minors were not as fortunate. They each suffered a rather serious injury and the injuries may be life-threatening. There are clearly many medical expenses and other damages arising from the incident. As with anyone involved in such an accident, it is important to consider the different laws that may be implicated by the incident to assess how to proceed to recover compensation for medical and other bills.

Laws that are noteworthy are those outlining the duties of the particular drivers involved in the collision. In this case, it may be useful to consider the Louisiana statutes regarding the operation of ATVs. These laws provide that ATVs may only be operated on roadways for certain purposes and at certain times by individuals with appropriate licenses and insurance.

If all of these requirements are not met, it may be more difficult for someone acting in violation of the law to recover from others involved in the incident. Ultimately, understanding the rights and duties of everyone involved in such incidents can help bring quicker recovery and compensation.
